Information and Consultation

Employees have a right to receive information and/or be consulted over a number of different issues including:

  • Redundancy
  • Certain business transfers
  • Health and safety
  • Terms and conditions of employment

From April 2008 employees in organisations with 50+ employees have been able to make a request for an arrangement to be put in place for information and consultation of representatives if 10% or more request it in writing.

Upon receipt of such a request, an employer is required to start negotiations to set up a representative structure. If not, a standard scheme will be imposed.

This right is set out in the Information and Consultation of Employees Regulations 2004.

In certain circumstances, consultation is required with individuals and representatives, such as where 20 or more employees are proposed to be made redundant.
