All employees have a right not to be subjected to words or conduct which they consider unwelcome and regard as offensive on the grounds of their sex or marital status, disability, race or ethnic origin, hours worked, trade union membership, sexual orientation, religion and belief, or age. Even where inappropriate conduct takes place outside the employer’s premises, it may still be regarded as harassment if it is connected to work, for example at an office party.

In a recent case, an employee brought a successful claim for harassment and bullying against their employer under the Prevention of Harassment Act. The case established that an employer may be vicariously liable for the acts of its employees. This case was brought in the civil courts. Unlike discrimination law in the Employment Tribunal, an employer is not able to rely on a defence that they took all reasonable steps to prevent the harassment occurring and the employee was able to recover their legal costs.
